Planning can help you manage your life while

he is still alive, not just when he dies. 

While alive:  You may need someone to help make sure your rent, mortgage, or other bills are paid. You may need someone to talk to your doctors when you are  temporarily too sick to do so. Both are normal situations that can occur in our lives. An advance health care directive and power of attorney can help you prepare for the unexpected as part of a probate plan.

Have children?You may want to make sure someone takes over to talk to the school or help with your child's health decisions if you are temporarily unavailable. These are also estate planning decisions and it is possible to create documents to address this.

Do you own a house? A living trust is part of an estate plan. It helps you make sure the house goes to the people you love after you die without them going to probate court and waiting for a judge to decide who gets your house. The fastest that can happen in California is usually 9 months, and that length of time can create problems for your loved ones. A living trust helps loved ones avoid this long waiting period, as well as probate court expenses.

Do you have a bank account? Maybe you have personal belongings that you want to make sure they get to a loved one. Making an estate plan helps you make sure your belongings go where you want them to go.

It is advisable to put your wishes in writing.

There are no court forms to do this, but you can find free legal forms online to help you. Some of the forms allow you to name someone you trust to make health care and financial decisions for you if you get too sick to do it yourself. Other forms say what you want if you become seriously ill or injured and after your death. These are sometimes called end-of-life or estate-planning documents.
